Acceptable Use Policy

This AUP governs the use of CloudBoxHosting’s web hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and CloudBoxHosting regarding the interpretation of this AUP, CloudBoxHosting’s interpretation, in its reasonable commercial judgement, shall govern.

CloudBoxHosting may refuse to accept any customer or any website for participation in the CloudBoxHosting hosting network as determined by CloudBoxHosting at its sole discretion. Any material that in our judgement that is obscene or threatening is prohibited and will be removed from our servers with or without notice.

Offensive Content

You may not publish or transmit via CloudBoxHosting’ service any content that CloudBoxHosting reasonably believes:

  • constitutes child pornography;
  • is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
  • is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
  • is defamatory or violates a person’s privacy;
  • creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with an investigation by law enforcement;
  • improperly exposes trade secrets or other confidential or proprietary information of another person;
  • is intended to assist others in defeating technical copyright protections;
  • clearly infringes on another person’s trade or service mark, patent, or other property rights;
  • promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
  • is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to CloudBoxHosting
  • is otherwise malicious, fraudulent, or may result in retaliation against CloudBoxHosting by offended viewers.

Using an account as a backup/storage device is not permitted, with the exception of one backup of the same account. Please do not take backups of your backups.

Content “published or transmitted” via CloudBoxHostings’ service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by CloudBoxHosting.

  • Image Hosting Scripts (similar to Photobucket or Tinypic)
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad services (commercial banner ad rotation)
  • File Sharing/Dump/Mirror Scripts (similar to Rapidshare)
  • Commercial Audio Streaming (more than one or two streams)
  • Escrow/Bank Debentures
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs
  • Lottery/Gambling Sites
  • MUDs/RPGs/PBBGs
  • Hacker focused sites/archives/programs
  • Sites promoting illegal activities
  • Forums and/or websites that distribute or link to warez/pirated/illegal content
  • Bank Debentures/Bank Debenture Trading Programs
  • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
  • Push-button mail scripts
  • Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
  • Tell A Friend Scripts
  • Anonymous or Bulk SMS Gateways
  • Bitcoin Miners
  • Pornography, adult content, and sex-related merchandising (This includes sites that may infer sexual content or link to adult content elsewhere.)

  • IRC Scripts/Bots
  • Proxy Scripts/Anonymizers
  • Pirated Software/Warez/Nulled Scripts
  • Image Hosting Scripts (similar to Photobucket or Tinypic)
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad services (commercial banner ad rotation)

CloudBoxHosting will be the sole arbiter as to what constitutes a violation of this provision.

Internet Relay Chat (IRC)

Use of Internet Relay Chat on any of our shared or dedicated servers is explicitly forbidden. This includes, but is not limited to, running any clients, bots, redirection services (proxies), or servers, of any kind.

Chat Applications

All interactive chat web applications are strictly prohibited on CloudBoxHostings’ servers. This includes but is not limited to chat applications written in PHP, Perl, CGI, Python, Ruby, etc. Any web application that provides ‘real-time’ chat is not permitted. Shoutboxes, chatboxes, live chat/live help (such as but not limited to LiveZilla) and other web-based chat programs are prohibited.

Resource Usage

All accounts are required to use as little server resources as possible. Because server resources such as CPU and memory are shared resources, excessive use of these resources can interfere with or completely prevent normal service operation for other Customers. CloudBoxHosting reserves the right to suspend or terminate Services on any account that, at its sole discretion, is mistreating or consuming an excessive amount of server resources causing server performance issues at any moment without previous warning, and for any or no reason.

Users may not: 

  1. Use 25% or more of system resources for longer than 90 seconds on shared/reseller services. There are numerous activities that could cause such problems; these include CGI scripts, FTP, PHP, HTTP, etc.
  2. Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. 
  3. Run any type of web spider or indexer (including Google Cash / AdSpy) on shared/reseller services.
  4. Run any software that interfaces with an IRC (Internet Relay Chat) network.
  5. Run any bit torrent application, tracker, or client. You may link to legal torrents off-site but may not host or store them on our shared/reseller services. 
  6. Participate in any file-sharing/peer-to-peer activities
  7. Run any gaming servers such as counter-strike, half-life, battlefield1942, etc 
  8. Run cron entries with intervals of less than 5 minutes.
  9. Run any MySQL queries longer than 60 seconds. MySQL tables should be indexed appropriately.
  10. When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”)
  11. To help reduce usage, do not force HTML to handle server-side code (like PHP and SHTML).
  12. Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.

Security

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically.

Bulk Commercial E-Mail

You must obtain CloudBoxHostings’ advance approval for any bulk commercial e-mail, which will not be given unless you are able to demonstrate all of the following to CloudBoxHostings’ reasonable satisfaction:

  • Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in procedure;
  • Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given;
  • You retain evidence of the recipient’s consent in a form that may be promptly produced on request, and you honour recipient’s and CloudBoxHostings’ requests to produce consent evidence within 72 hours of receipt of the request.
  • The body of the e-mail must describe how the e-mail address was obtained, for example, “You opted-in to receive this e-mail promotion from our Web site or from one of our partner sites,” and information on how to request evidence of the consent, for example, “If you would like to learn more about how we received your e-mail address please contact us at abuse@**yourdomain.com**.”
  • You have procedures in place that allow a recipient to easily revoke their consent – such as a link in the body of the e-mail, or instructions to reply with the word “Remove” in the subject line. Revocations of consent are honoured within 72 hours, and you notify recipients that the revocation of their consent will be honored in 72 hours;
  • You must post an abuse@**yourdomain.com** e-mail address on the first page of any Web site associated with the e-mail, you must register that address at abuse.net, and you must promptly respond to messages sent to that address;
  • You must have a Privacy Policy posted for each domain associated with the mailing;
  • You have the means to track anonymous complaints;
  • You may not obscure the source of your e-mail in any manner. Your e-mail must include the recipient’s e-mail address in the body of the message or in the “TO” line of the e-mail; and
  • You otherwise comply with the CAN SPAM Act and other applicable law.

These policies apply to messages sent using your CloudBoxHosting service, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site hosted via your CloudBoxHosting service. In addition, you may not use a third party e-mail service that does not practice similar procedures for all its customers.

CloudBoxHosting may test and otherwise monitor your compliance with its requirements, including requesting opt-in information from a random sample of your list at any time.

Unsolicited E-Mail

We take a zero-tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or Usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

CloudBoxHosting reserves the right to require changes or disable as necessary any web site, account, database, or other components that does not comply with its established policies or to make any such modifications in an emergency at its sole discretion.

CloudBoxHosting reserves the right to charge the holder of the account used to send any unsolicited e-mail a cleanup fee or any charges incurred for blacklist removal. This cost of the cleanup fee is entirely at the discretion of CloudBoxHosting.

Material Protected by Copyright

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:

  • you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner;
  • you are otherwise permitted by established United Kingdom copyright law to copy the work in that manner.

CloudBoxHosting will terminate the service of repeat copyright infringers.

Copyright Infringement Notice (Digital Millennium Copyright Act)

If you believe your copyright is being infringed by a person using the CloudBoxHosting network, please send your written notice of copyright infringement to:

Your notice must include the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single site are covered by a single notification, a representative list of such works at that site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit CloudBoxHosting to locate the material;
  • Information reasonably sufficient to permit CloudBoxHosting to contact you, such as an address, telephone number, and, if available, an e-mail address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Other

You must have valid and current information on file with your domain name registrar for any domain hosted on the CloudBoxHosting network.

You agree that when communicating with our staff, all communication will be void of profanity and/or abusive demeanor.

Disclaimer

CloudBoxHosting is under no duty and does not by this AUP undertake a duty, to monitor or police our customers’ activities and disclaims any responsibility for any misuse of the CloudBoxHosting network.

Internet Abuse

You may not engage in illegal, abusive, or irresponsible behaviour, including:

  • Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures (including those belonging to CloudBoxHosting and its customers) without express authorization of the owner of the system or network;
  • Monitoring data or traffic on any network or system without the authorization of the owner of the system or network;
  • Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
  • Use of an Internet account or computer without the owner’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning;
  • Forging of any TCP/IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
  • Any conduct that is likely to result in retaliation against the CloudBoxHostings’ network and/or services.
  • Use of CloudBoxHostings’ network and/or systems in a way that unreasonably interferes with CloudBoxHostings’ other customers use of the same resources.
